91 Dispatcher — Terms of Service

1. Acceptance of Terms

By creating an account or using 91 Dispatcher ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

91 Dispatcher is a preflight decision-support tool for general aviation pilots. The Service provides synthesized weather data, risk assessments, dispatch briefs, logbook management, and flight replay features.

3. Advisory Nature of Information — PIC Authority

All information, recommendations, and assessments provided by 91 Dispatcher are advisory only.

The Service does not replace:

  • Official FAA weather briefings (1800wxbrief.com or FSS)
  • The pilot's own preflight planning and risk assessment
  • Any regulatory requirement for flight planning or weather information
  • The judgment and authority of the Pilot in Command (PIC)

Under 14 CFR 91.3, the Pilot in Command is the final authority for the safe operation of every flight. No output from 91 Dispatcher — including risk verdicts, go/no-go recommendations, personal minimums evaluations, departure window suggestions, or alternate airport selections — constitutes a directive, clearance, or authorization to fly.

You are solely responsible for:

  • Verifying all weather data against official sources before flight
  • Making your own go/no-go decision
  • Ensuring legal compliance with all applicable FARs
  • Operating the aircraft safely regardless of any assessment this Service provides

4. No Guarantee of Accuracy

91 Dispatcher aggregates data from third-party sources including but not limited to:

  • Aviation Weather Center (aviationweather.gov) — METARs, TAFs, SIGMETs, AIRMETs, PIREPs
  • FAA aeronautical data (NASR, CIFP, d-TPP) — airports, runways, approaches, waypoints, NOTAMs
  • FAA Winds and Temperatures Aloft forecasts

While we strive for accuracy, we do not guarantee that:

  • Weather data is current or complete
  • Risk assessments correctly capture all relevant hazards
  • Calculated values (ETAs, crosswind components, freezing levels) are error-free
  • Airport, runway, or approach procedure data reflects the latest AIRAC cycle
  • Advisory filtering (SIGMETs, AIRMETs, PIREPs) captures every relevant hazard along your route

Weather conditions change rapidly. Data may be delayed, incomplete, or inaccurate due to source outages, transmission errors, parsing errors, or stale AIRAC cycles. Always cross-reference critical information with official sources.

5. Risk Assessment Limitations

The risk assessment engine uses a deterministic scoring model based on factors including weather conditions, pilot currency, personal minimums, aircraft equipment, and airspace complexity. These assessments:

  • Are based on general risk heuristics, not the specific circumstances of your flight
  • Cannot account for all hazards (mechanical issues, physiological factors, external pressures, etc.)
  • May under-weight or over-weight certain factors relative to your specific situation
  • Are not a substitute for training, experience, or sound aeronautical decision-making (ADM)

A "LOW RISK" verdict does not mean a flight is safe. A "HIGH RISK" verdict does not mean a flight cannot be conducted safely. These are informational signals, not directives.

6. Personal Minimums

The personal minimums feature allows you to define your own operating limits. 91 Dispatcher evaluates these against forecast conditions and flags violations. However:

  • The system evaluates only the minimums you define — it cannot identify risks you have not accounted for
  • Forecast data used for evaluation may differ from actual conditions at flight time
  • "SATISFIED" status means the forecast meets your stated minimum — it does not mean conditions are safe
  • You are responsible for setting appropriate personal minimums based on your training and experience

7. Currency and Proficiency

Currency data displayed in 91 Dispatcher (IFR approaches, night landings, flight review dates, etc.) is computed from flight records you import or enter. The accuracy of currency calculations depends entirely on the completeness and accuracy of your logbook data. 91 Dispatcher does not independently verify your currency or legal qualification to act as PIC.

8. AI-Generated Content

Certain features may use artificial intelligence to generate narrative summaries, brief text, or other content. AI-generated content:

  • May contain errors, omissions, or misinterpretations
  • Is provided for convenience and should not be relied upon as the sole basis for any decision
  • Does not constitute professional aviation advice
  • Is subject to the same advisory-only limitations as all other Service output

9. Account and Data

  • You are responsible for maintaining the confidentiality of your account credentials
  • Flight data, pilot profiles, and aircraft records you create are owned by you
  • We do not share your personal flight data with third parties without your consent
  • You may request deletion of your account and associated data at any time
  • We may retain anonymized, aggregated data for product improvement

10. Acceptable Use

You agree not to:

  • Use the Service as a substitute for required FAA weather briefings
  • Rely solely on the Service for flight planning decisions
  • Share your account credentials with others
  • Attempt to reverse-engineer, copy, or redistribute the Service
  • Use the Service for commercial dispatch operations (Part 121/135) — it is designed for Part 91 operations only

11. Limitation of Liability

To the maximum extent permitted by law, 91 Dispatcher, its operators, developers, and affiliates shall not be liable for:

  • Any loss, damage, injury, or death arising from the use of or reliance on information provided by the Service
  • Any decision to fly or not to fly based on Service output
  • Any inaccuracy, delay, or omission in data obtained from third-party sources
  • Any interruption, outage, or unavailability of the Service

You acknowledge that aviation is an inherently risky activity and that the decision to fly rests solely with the Pilot in Command.

12. Indemnification

You agree to indemnify and hold harmless 91 Dispatcher, its operators, developers, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or any flight operations informed by Service output.

13. Beta Program

During the beta period, the Service is provided as-is with no uptime or accuracy guarantees. Features may change, data may be lost, and the Service may be discontinued. Beta users accept these additional risks.

14. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email or in-app notification.

15. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
